I think Brian’s point is that, apart from the facts of this specific incident, false allegations of rape are exceptionally rare. Especially in cases where an indictment is returned. So in the overwhelming number of cases where a woman chooses to go forward to the police, something criminal did happen. Those probabilities obviously aren’t a basis for a conviction but I sure don’t think it’s an unreasonable basis for him to choose not to root for a particular NFL team.

Just don't think an indictment necessarily means much. Particularly in a rape case. I guess I'd have to review the research to know a particular percentage but they call it he said she said for a reason. It's really hard to know. The other side of this can be compellibg as well.

I could just be a pussy libtard but I think you have to cut ties with anyone who might be a rapist. I mean I agree the individual facts in any case matter because there can be false allegations but imagine how convincing the evidence must have been to get an indictment for a sexual assault on South Padre in the mid-90s. I mean seriously think about that. This isn’t Tom Brokaw smacking a woman’s ass. This is a brutal rape that was reported. There had to have been some physical evidence you’d assume.

Because this is a worthwhile conversation, ill offer (without knowing or having any research) that its likely that those percentages change depending on the situation. Would think acquaintance rape has a higher false allegation rate than stranger rape. Would think that race also changes those percentages. Would guess that that percentage changes when multiple people are involved. Athlete involvement and age likely changes the percentage. Obviously alcohol/drug impairment impacts those percentages too.

At the least in this guys case, the presence of a third person makes for a variety of factual scenarios. Also probably made the case a lot harder to make for the prosecutor. Not to mention brings up the question of whether consent to one dude = consent to his buddy. Clearly the answer seems no but what when its unclear or when impairment brings into question that consent. Not saying thats what occurred here, just to ask a million other questions that make rape allegations a lot more difficult to discern. Particularly in the sports league and educational institutional context vs. criminal justice.

Understood, I guess, but all those variables go into the denominator Brian first brought up. Most every case will have something that might make it seem potentially false. Most of those cases won't be false.

Big difference though between 98% and say 66%

Yeah, either way the majority actually raped someone but even if you can get your head wrapped around jailing (or firing/expelling) 2/100 innocent guys, there no way you can do that to 1/3. You have to put yourself in those shoes. I get that there is a victim but you cant double up the injustice by assuming all allegations are true.

In rape cases, the most important thing is that the victim is taken seriously - even if it proves out that nothing improper happened after investigation. It seems that they did take her seriously, as they were immediately arrested and charges were filed. It's hard to know what happened to cause her not to show up and pursue it, but - and it pains me to say this because I feel strongly about these types of things and if she were raped then the rapists need to see justice - it seems like the law worked as it should have in this instance.

My question is why we are reading about this now? This story was reported on at the time - Patricia's been in the public eye for years. No one thought to do an in depth search on his name before?

I'm guessing part of the reason the Lions didn't due the proper due diligence is because Patricia had been employed in the NFL for several years already, so there was probably a level of "we'd know already if this dude was bad."

Nothing really to add here, but one of the lesser fucked up things about rape is that if the person accused was accused of assaulting a woman with his fist, foot, or head instead of his dick there's no blaming the victim.
