fWAR leader didn't win the AL Cy, but the 8 pitchers that did receive votes all finished top 9 in the stat (sorry Jose Berrios). No way to prove it of course, but I wonder if Cole's hat or the fact that he was facing Verlander hurt him.

What percentage of players do you think violate some term in their contract? I would love for him to counter-claim they prevented him from progressing to a rehab assignment just to keep maintain the insurance.

I have no idea, not that it would have any bearing on this situation though. I can also see where the Yankees went full-disclosure with the insurer whenever they uncovered his infraction to prevent any appearance of impropriety.

It’s technicality shit and after this and Alex-Rod (and maybe Pavano), I’d start to think about avoiding this team if I were a 6+ year UFA.

Ellsbury got hurt and the Yankees benefited from his insurance. No one would argue that part.

Again, not relevant. When Ellsbury went to a non-sanctioned medical facility to receive treatment from non-sanctioned medical providers he violated the CBA, and when his injuries compounded? He was ripe to have his contract nullified (which will go to arbitration). Also, I don’t doubt for a second the team have been squaring things with the insurance company since day one. Another thing: how’d this all start? Might it have been the Yankees doctors sounded an alarm that his recent injuries would not have happened had he been rehabbing / receiving treatment at Yankee-authorized facilities?

There are a hundred what-ifs you can put here, but the fact is the Yankees haven’t wanted to carry his money since 2017 and are only doing this, CBA legal or not, because insurance is up. It’s a shit move whether or not it works.

It has the smell of mgmt v labor (beyond Yankees v Ellsbury). It might be a precedent-setting move where if a player seeks his own medical help for an on-field injury he risks voiding his contract.

Only once since Brian Cashman became general manager in 1998 have the Yankees sought to terminate a contract – in 2003, after outfielder Bubba Trammell left the team in June. Trammell later revealed he was suffering from depression. The two sides eventually reached a settlement on the balance of Trammell’s $2.5 million salary.
The Yankees knew Ellsbury was getting treated by PMC at that time, according to Bouquette’s account of their interaction. But they did not seek to terminate Ellsbury’s contract then.

The complementary, or let’s call it for what it is, alternative medicine going on at PMC (from the same article you linked):
The PMC has treated nearly 26,000 patients since 1999, Bouquette said. The center employs naturopaths, chiropractors, acupuncturists and dietitians, with a goal, according to its web site, of “defining better health solutions through our whole-person approach, advanced diagnostics and customized personal plans.” In 2011, Bouquette was disciplined by the Georgia Medical Board after the death of a patient nine years earlier.
We don’t know enough facts, but I’m guessing one of three things:

1) Mgmt v Labor. Hundred million dollar players have no business seeing quacks. Whether or not Bouquette is a quack remains to be seen, but this could be the case that tightens up some definitions in the CBA.
2) Randy Levine is being a moron for failing to insure the last year of Ellsbury’s contract.
3) A board of physicians reviewed Ellsbury’s medical records from his time at PMC and believe his pathway back to the field was hampered by them.

No you can't. If the medical review board sees something that happened at an alternative medicine shop that delayed his return to action, then that's the cause they'd use to void the remainder of his contract.
