Say Manchin casts the deciding vote to confirm Kavenaugh, which allows him to keep his seat which ends up allowing the Democrats to take the senate (and assume the house too). Do you take that trade off - control of congress for a horrible, conservative supreme court judge?

If he knows he can get away with it, which Kavanaugh allows for, the answer is “a lot more”. And that’s before you get into the social issue disasters this SCOTUS can cause.

The American Bar Association has urged the Senate to delay a vote on Kavanaugh so that the FBI can do a proper investigation into Kavanaugh.

I’d like to see some justices on the court weigh in. I won’t hold my breath on that, though.

I guess another complication is the fact that if Kavanaugh goes down, they just put another right wing justice on the Court. So a vote by Manchin for Kavanaugh probably doesn't have much practical implication. Other than telling millions of women their lives don't matter.

Prediction: Flake and Collins vote No; Manchin and Heitkamp vote Yes. Kavanaugh gets confirmed without further investigation and Flake and Collins get to pretend to be reasonable. No reason at all for Flake to vote to advance him out of Committee if he actually wanted the investigation to occur.

But I think he thinks that not allowing it out of Committee was procedurally problematic. And like I said, this gives a bunch of fence sitters the logical and political coverage they need to vote no.

And I really don't think Manchin is going to fall on this sword. This is way too toxic. His turnout would be terrible.
