In all honesty, I don't think the Rs will fill the seat before Election Day. There are too many R senators fighting for seats and will fear a backlash if they push a nomination through.

But after Election Day? There is no leverage over anyone.

To be fair, I think even the current Democratic leadership realizes if the GOP fills the seat before the election or after a Biden win, then the only response is to take the court to 11. I'm not even really worried about that. The harder part is going to be getting to 51 Dem senators this November so they can do it.

There's also this option, though arguably it plays into Trump's hands. Get ready for him to use the nomination fight to provoke widespread protests and wildcat strikes.

Nothing works in shaming Republicans. They either already have a sense of some things going too far, or they don’t. Even the threat of losing their seats only goes so far.
