They didn't vote for it, it was 9-0 against hearing the BS.

Separately, justices Samuel Alito and Clarence Thomas said they would have allowed the case to be filed, but would grant no other relief.

Apparently they believe the Court is required to take original jurisdiction cases?tennbengal wrote: ↑Fri Dec 11, 2020 7:05 pm They didn't vote for it, it was 9-0 against hearing the BS.

Yeah that’s clearly not about this case, but rather whatever arcane position they’ve staked out in other cases. I’ll keep that in mind for when I launch my state vs state original jurisdiction practice.

So we WON'T get to see Ted Cruz in front of the Supreme Court arguing to keep the guy who called his wife ugly in office?
I'm disappointed.

Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
Is having that statement coming from Alito and Thomas intentional? Would Roberts says, "to show how crazy this suit was we'll have these two crazy political hacks write the statement."
Also, when I quickly looked at the Texas GOP logo I thought the Montreal Expos had made a statement.

Don’t forget all those cases affecting Ambassadors.

Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
Long story short, it is not unusual for justices to concur in the result while staking out a position that goes against the majority but would lead to the same result. Basically, they are saying “I agree with the result reached by he majority but would have decided the case on the basis of reason X rather than reason Y.” Because X and Y lead to the same result, it doesn’t matter for the present case, BUT appellate judges are always thinking about future cases. This was a message sent to future litigants in state vs. state cases, and has nothing to do with the specifics of this lawsuit. (Most state vs. state cases have nothing to do with election law—they are fights over stuff like water rights).
The fact that they said they would have thrown the case out for reason Y, which unlike reason X was related to the merits of the lawsuit, IS significant, especially considering that this was coming from Alito and Thomas.
Just spitballing here, but I’m guessing that Roberts spent some time trying to find an issue where there was complete unanimity so as to avoid this confusion. But other justices may have been just as willing to hold out on reason X, so this was the best way to proceed.

I mean I understand the rulings but has anyone told SCOTUS that psunate says Trump is definitely the big winner? Just wondering.

Forgot where I read it, but Putin was guessing Trump would lose in 2016 and then put doubt in democracy with allegations of election fraud. So now we're just getting a view of what would have happened if Hillary won, except instead of Barr and a much more conservative court rejecting ridiculous allegations, evil Obama appointees would have been doing it. It's worth destroying democracy to destroy the Democrats, I guess.

The hilarious thing is which country are these wannabe Nazis gonna move to? Hungary? Turkey? Poland? The US is already by far the most right-wing country in the First World, more or less.

I don’t know what thread to raise an eyebrow about this so I will raise the eyebrow here:
Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
I know I'm harsh on Biden, but I have to admit there isn't anyone more qualified to run the $75B budget of the dept of transportation than "Mayor" Pete Buttigieg.

And his ambassadors better all have advanced degrees in ambassadoring.
Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
Let me help: Pete dropped out of the race and endorsed Biden when told.

So that makes him unfit for a position?

Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
Doesn't seem like the type of post you hand out as an award for letting you win the nomination. It wields no influence or prestige, and isn't a jumping off point for someone with future ambitions. I just looked at the list of former Transportation Secretaries, and I don't think a single person went on to anything bigger afterwards. Ok, Andrew Card was Transportation Secretary under HW Bush, then Chief of Staff under W. Other than that, 2 wives of prominent Senators and a couple vaguely familiar names who I remember hearing as Sec of Transportation.
I don't think you really need experience in the field of transportation, you just need someone with good management skills and a willingness to hire and listen to experts. I kept hearing he'd get an Ambassadorship to China, which could be considered a plum gig. I'm curious how the Chinese would feel about a married gay man in that role.

Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
What has he done besides be mayor of a 4th rate city and then decide to try to be president? Any time Buttigieg comes up it seems like the onus is on proving the negative versus anyone defending him saying what makes him qualified for _______.
Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
Pete would've been excellent at some sort of gig where he's being a diplomat and engaging with foreign nations. He was a prior Intel officer in the Navy. He has the temperament, presence, and wit. Plus he speaks 7 languages.
I'm literally more qualified to be Transportation Secretary. And I'm not even that qualified. Sure he's more qualified than McConnell's wife, but also, so am I.
This is his reward for dropping and endorsing when told, as Mr. D said. It's absolutely obvious.
All that being said, if his day 1 vision for America as the Transportation Secretary isn't facilitating "a high speed rail system like that of Europe or Japan," then fuck off. America is long overdue for one.

Re: The WH Transition Thread --- all things Trump to Biden until Inauguration
Would have thought Pete would get an ambassador gig that one of the languages he speaks would be handy but the job would be really easy. Like Norway or Italy maybe.
(Then maybe move him to State after a bit, then a Senator or Gov and then bring him back into the Presidential fold.)
