I'm not up on the details, but I think they are treading a fine line under the Federal Wiretap Act. State laws, too.

After looking at the definitions (who am I kidding, after looking at Wiki), I think recording the telephone call was a fairly clear violation of the federal Wiretap Act.

This definitely violates Florida law as well. These jokers are headed to pound you in the ass prison, with no conjugal visits.

In Florida only one person has to be aware. Do the people taping it not count because they aren't in the conversation?

Same with under the federal act.

But I think that since the communications were between two GMs, and neither of them consented to communications being recorded or disclosed, it was illegal.

I think the listening may actually have been okay, since the Deadspin guys really didn't do anything special other than call two people at the same time. But the recording is a separate act, as was the broadcast of that recording.

Then again, presumably this crossed the minds of the guys at Deadspin, and I would hope they would have asked a lawyer before they broadcast the recording. And hopefully that lawyer did more than spend five minutes on Wikipedia.

Florida law is a "two-party" consent state. Both must be aware.

According to this, in Florida, the category of offense would likely be a third-degree felony, punishable by up to five years in jail. Damn.

Ah. I was under the impression the guys from Deadspin actually did the recording.

According to the article, they are off the hook, though I'm not sure if I buy it.
