Sounds like it to me. I just went through a "what questions you can ask in interviews" class here at the Institute (they are worried about someone going after Paul Allen and his deep pockets), and asking about disabilities, short of something that would obviously impact one's ability to do the assigned task, are WAY out of bounds.
I don't know about asking in an interview, but asking if you have disabilities is a VERY common question in the online application process.
But usually they are smart enough to ask about disabilities "that may interfere with your ability to perform any of the functions of the job."
*That* question is legal. I think the ADA might actually prohibit asking a general question about disabilities.
Is the question part of the voluntary EEOC statistics where they ask gender and race? If so, that is supposed to be anonymous, just a total tally to send to the EEOC or have on file if there is a claim of discrimination in the hiring process. The people involved in the hiring process should not be able to see which candidates claimed a disability or what race or gender they selected.
Employers can only ask about a disability if a candidate or employee has an obvious disability, and they can only ask if the person requires a reasonable accommodation to perform the duties of the job. You can never ask for a medical diagnosis, or raise the issue of a reasonable accommodation unless the employee/applicant raises it first, or it's obvious to the point of a person in a wheelchair for a job that requires heavy lifting. If the employer thinks a candidate or employee may have a disability, the only question they can ask is, "are you able, with or without a reasonable accommodation, to perform the duties of the job."
To answer L-Jam's original question, I would not recommend disclosing your depression unless you are requesting an accommodation necessary to perform the job.

hitting the 3 year mark next week.. likely at the same time i get additional responsibilities...which likely mean i no longer have to be based anywhere near NYC... but would be good to be near Delaware, California or Texas.. additionally as the missues is spending 2-3 days a week on the road working on a major redevelopment project off i95 in baltimore for an unnamed athletic wear company..her company is now in talks w her about changing offices (from ny towards the south) and maybe mgmt..but they're also located in texas...
so i guess the poll question is ...
would you rather have the oppty to have beers with the dc/balto swamp crew once in a while, or bask in the glory that is Giff?
looking at trulia trying to figure out where i should pin my hopes and dreams and new mortgage.

I'm thinking Anne Arundel County/Annapolis cooridor for you. Close to B-more but if you are working from home you can live on the water. Puts you drive able to B-more and DC (and BWI Airport)

+1 avoid Wilmington. Lived in the city for a year. Eastern shore of MD would be fun. Same with Annapolis.

I don't know what version of Adobe Acrobat is being used, but XI Pro is what we have at work. File >> Save As Other >> Microsoft Word is much easier than going through something else to create the file, imo.

As someone who spends a significant amount of time word-smithing responses to questions like that in order to imply a) how dumb of a question it is, and b) how much of a pain in the ass it is on my end, I think that was pretty mild.
Well, I meant if they feel like they needed to manipulate whatever it is. Jerloma never said what kind of document it was he made a PDF of (though using InDesign implies it was just some kind of basic flyer/one sheet type thing)
