Typically not for the prosecution in a criminal case, because if there is a not guilty verdict, retrial isn’t an option on appeal because of double jeopardy.

You'd have to lobby for a mistrial before the verdict I would think. Once the jury gives its verdict, any not guilty is set in stone.
